Assumed Name Law & Legal Definition

The law of many states, which vary by state, requires businesses to file assumed name certificates. Also, many banks will not allow a business checking account to be opened without a proper filing. Neither the filing of an assumed name certificate nor the reservation or registration of a company name imparts any real protection to the party filing. It is merely a formal process that informs the general public of the registered agent for a business, and where official contact with the business can be made.

General Steps to Follow:

  • Decide on the name of your business.
  • Search the County Assumed Names records for the availability of the name of the business.
  • It is always best to search all variations of the business name.

Example: the name Dandz should be searched d and z, dandz, z&z, d&z.
