Common Duty of Care Law and Legal Definition
Common duty of care is a landowner's obligation to take reasonable care. Such reasonable care should be taken under the circumstances to see whether a lawful visitor is reasonably safe while using the premises for the purposes for which the visitor is invited or permitted to be there. It is the duty of an occupier of land or premised to take reasonable care in seeing that the visitors will be reasonably safe in using the premises.
