Ex-parte Divorce Law & Legal Definition

Ex-parte divorce is a divorce proceeding in which only one spouse participates or appears in Court. In order for an ex-parte divorce decree to be valid, the non-participating spouse must have been provided with proper notice of the divorce proceedings. In spite of proper notice, if the spouse decides not to appear and contest, then it will result in an ex-parte decree.
