Habere Facias Seisinam Law & Legal Definition

This is a writ of execution used in most real actions. This writ directs the sheriff to cause the demandant to have seisin of the lands which he or she has recovered. If the Sheriff delivered more than a person was entitled to this writ can compel the Sheriff to return the excess This writ should be taken out at any time within a year and day after judgment. For the purpose of execution of the writ the sheriff may break an outer or inner door of the house, and, in case of violent opposition, Sheriff may raise the posse comitatus.
