Prescription of Nonuse Law and Legal Definition
Prescription of Nonuse is a mode of extinction of a real right other than ownership as a result of failure to exercise the right for a period of time. For instance as per the laws of Mississippi, “a mineral servitude is extinguished by:(a) Prescription resulting from nonuse for ten (10) years.”
