Punishment Witness Law & Legal Definition
A punishment witness, also known as a sentencing witness, is a witness who may be called after a conviction has already been entered. A punishment witness' testimony is taken for the purpose of influencing the sentence imposed by the presiding judge. Punishment witnesses may be called by either the prosecution or defense.
