Unfavorable Witness Law & Legal Definition

Unfavorable witness is one who gives unfavorable answers to questions asked during examination in chief. The party who had called such witness need not cross examine the witness; however the party may lead evidence in contradiction. Unfavorable witness is a general exception to the rule of evidence that a litigant cannot call a witness and then during examination in chief, proceed to discredit his or her own witness.
