Vinculo Matrimonii Law & Legal Definition

Vinculo matrimonii is a Latin term that means "from the bonds of marriage." It is a term that refers to a complete divorce, as opposed to a partial divorce, called a mensa et thoro. A divorce vinculo matrimonii applies when the marriage was never legal, as in the case of bigamy, or marriage within the prohibited degrees of kinship. A divorce a mensa et thoro is because the parties cannot live together due to incompatibility, in which case they may reunite if they so choose.
