A Mensa Et Thoro Law and Legal Definition
A Mensa Et Thoro is a Latin term which means “from board and hearth”. It is a kind of divorce which does not dissolve the marriage bond, but merely authorizes a separate life of the husband and wife. This is similar to a court-sanctioned separation where the husband and wife are not legally obligated to live together, but their marriage has not been dissolved. It may be granted for the causes of extreme cruelty or desertion of the wife by the husband. This kind of divorce does not affect the legitimacy of children .When the divorce is a mensa et thoro, neither spouse can remarry.
