Abusive Discharge Law and Legal Definition
Abusive discharge refers to a claim by an employee who is fired that the firing breached some clear mandate of state public policy. In such cases the employee instead of relying on an employment contract or an express statute that would prohibit termination, attempts to show that the firing violated a general public policy adopted by the state. Usually, abusive discharge claims are resorted to when no claim for breach of contract or violation of a statute can be alleged.
