Accusatory instrument is a generic term that describes a variety of documents that accuse a defendant of an offense. It is the initial pleading or other paper which forms the procedural basis for a criminal charge. If the accusatory instrument is defective, the entire proceeding will be rendered null and void. Criminal complaint is an example of an accusatory instrument.
