Adult Education Population [Education] Law and Legal Definition
According to 34 CFR 462.3 [Title 34 – Education; Subtitle B -- Regulations of the Offices of the Department of Education; Chapter IV -- Office of Vocational and Adult Education, Department of Education; Part 462 -- Measuring Educational Gain in the National Reporting System for Adult Education; Subpart A – General], the term adult education population means “individuals--
(1) Who are 16 years of age or older;
(2) Who are not enrolled or required to be enrolled in secondary school under State law; and
(3) Who--
(i) Lack sufficient mastery of basic educational skills to enable the individuals to function effectively in society;
(ii) Do not have a secondary school diploma or its recognized equivalent, and have not achieved an equivalent level of education; or
(iii) Are unable to speak, read, or write the English language.”
