Advice-of-Counsel Defense Law and Legal Definition
In relation to patents law, in an action for infringement, advice-of-counsel defense is an assertion that the plaintiff sought and obtained from the attorney after learning the owner’s rights. The plaintiff relies on the attorney’s well-reasoned opinion before pursuing the challenged act. The assertion is treated as a factor in determining the act as willful. This is not a true defense.
