Affidavit of Service Law and Legal Definition
Affidavit of service means an affidavit supporting delivery of case-related papers to one or more parties in a legal matter. It certifies service of a notice, summons, writ, or process. It shall also state the time, manner, and method of delivery in a summary manner. The sending representative must also sign, or swear to, the truth of the summary statement that s/he enters in the affidavit.
It is also called as a proof of service, an affidavit of service. Service of legal papers containing details of a case or judgment is mandatory to both the plaintiff and defendant. Affidavit of service lets one know the other has received a duplicate set of papers.
