Affidavit [Patents] Law and Legal Definition
According to 37 CFR 41.2 [Title 37 -- Patents, Trademarks, and Copyrights; Chapter I -- United States Patent and Trademark Office, Department of Commerce; Subchapter A – General; Part 41 -- Practice Before the Board of Patent Appeals and Interferences; Subpart A -- General Provisions] the term affidavit means “affidavit, declaration under § 1.68 of this title, or statutory declaration under 28 U.S.C. 1746. A transcript of an ex parte deposition may be used as an affidavit in a contested case.”
