Agreement to Sell Law and Legal Definition
An agreement to sell is "a contract to be performed in the future, and, if fulfilled, results in a sale. It is preliminary to a sale, and is not the sale. Breaches, rescission, or release may occur by which the contemplated sale never takes place." Hoven v. Commissioner, 56 T.C. 50, 56 (T.C. 1971)
