Assignment by Delivery Law and Legal Definition

Assignment by delivery is the transfer of title to a chose in action by handing over to the assignee the evidence or symbol of title or ownership.

When commercial paper, payable to bearer, is transferred by delivery, both the right of property, and the right to sue pass thereby to the transferee. [Enloe v. Reike, 56 Ala. 500, 504 (Ala. 1876)].
