An auction is a public sale of property where the contract of sale is formed by means of competitive bids, submitted, and confirmed according to the pre-established terms and conditions that govern the auction sale. The auctioneer is the person who conducts the sale and is compenated for such services. An auctioneer may sell the auctioneer's own property or the property of others. When selling property on behalf of another person, an auctioneer is an agent of the seller for most purposes, but the auctioneer is an agent of both the seller and buyer for the purpose of preparing and signing memoranda of sale.
