Automatic Restraining Order Law and Legal Definition
Automatic Restraining Order is an order that freezes the assets that goes into effect automatically upon events. For example, when the divorce petition is served, neither spouse can take any children out of state, sell or borrow against property, or borrow or sell insurance held for the other spouse. This also includes the filing of a divorce or a court order restricting an individual from taking part in certain actions or transactions. These orders remain in effect until the judgment is signed by the court.
Some restraining orders order that s/he is not allowed within a set distance from the other spouse, and/or children, and/or a marital home or school. Such restraining orders require a more complex procedure proving to the court that a restraining order is warranted.
