When there is a conflict between trademarks, there are several types of lawsuits which could be brought before courts. Under 15 USCS § 1114, suit can be brought for trademark infringement. Suit can be brought against false designation or description under 15 USCS § 1125. Violation of 15 USCS § 1125 can also result in a suit for trademark dilution. Violation of state trademark infringement statutes can result in lawsuits in the state courts. Common law trademark infringement, violation of state unfair competition and deceptive practices statutes, common law unfair competition, and common law or state statutory violations of the right of publicity can also result in lawsuits.
