According to 7 CFR 110.2 [Title 7—Agriculture; Subtitle B -- Regulations of the Department of Agriculture; Chapter I -- Agricultural Marketing Service H1 (Standards, Inspections, Marketing Practices), Department of Agriculture; Subchapter E -- Commodity Laboratory Testing Programs Part 110 -- Recordkeeping on Restricted Use Pesticides by Certified Applicators; Surveys and Reports] commercial applicator is “a certified applicator, whether or not the individual is a private applicator with respect to some uses, who uses or supervises the use of any restricted use pesticide for any purpose on any property other than as provided by the definition of private applicator.”
