Continuing Damages Law and Legal Definition
Continuing damages mean damages arising from the same injury but continued at different times. For instance, a person who tramples the grass of the plaintiff upon successive day's commits continuing damages. The continuing damages provision does not violate constitutional concepts of access to courts or due process. The court's conclusion is dependant upon its view that the continuing damages provision is intended solely to reimburse the injured.
