Continuity of Residence Law and Legal Definition
When an alien is seeking U.S. residency, an absence of more than one year will automatically lead to a break of the continuity of such an alien’s residence. If the continuity breaks, the alien should begin the process all over again. Although an applicant can get permission to leave the U.S. during the residency period, it is generally not recommended to leave.
