Covenant in Fact Law and Legal Definition
Covenant in fact is a covenant expressly agreed between the parties and inserted in the deed. However, law does not require any particular form to create an express covenant. Covenant in fact binds the party expressly though they become afterwards unlawful. [Moale v. Tyson, 2 H. & McH. 387 (Md. 1789)].
