Covenant Running With the Land Law and Legal Definition
Covenant running with the land is a real covenant, a covenant under which either the liability for performance or the right to performance passes to a vendee or assignee.
The following is an example of a state statute (California) referring to covenant running with the land:
Cal Civ Code § 1462. Every covenant contained in a grant of an estate in real property, which is made for the direct benefit of the property, or some part of it then in existence, runs with the land.
