According to 34 CFR 76.787 [Title 34 – Education; Subtitle A -- Office of the Secretary, Department of Education; Part 76 -- State-Administered Programs; Subpart H -- How does a State or Local Educational Agency Allocate Funds to Charter Schools?; General], the term covered program means “an elementary or secondary education program administered by the Department under which the Secretary allocates funds to States on a formula basis, except that the term does not include a program or portion of a program under which an SEA awards subgrants on a discretionary, noncompetitive basis.”
