Damnum Infectum Law and Legal Definition
Damnum Infectum is a Latin term which means “loss not yet suffered but threatened or apprehended.” For example, it means a loss apprehended when a neighbor’s building is about to collapse onto one’s property. Every person who was in possession of the property that was about to collapse, whether as owner or in any other right (but not as a bonae fidei possessor) will have a claim for security.
