De Identitate Nominis Law and Legal Definition
De identitate nominis is a Latin term which means “of identity of name “or “of identical name.” It refers to a writ issued to free a person who is falsely arrested and imprisoned in the place of a person with same name. This writ shall be directed to the escheater if s/he or his/her goods are arrested by the escheater, and in cases where the arrested is vexed or molested then this writ will be issued to the sheriff. It is also termed as de idemptitate nominis.
