Defense, Uncontrollable Circumstances Law and Legal Definition
Under uncontrollable circumstance defense, a person can take a defense that uncontrollable circumstances prevented the person from appearing or surrendering. It is a defense to criminal charges like failure to appear or surrender. To establish uncontrollable circumstance defense, the person must prove that uncontrollable circumstances prevented the person from appearing or surrendering. The person shall further prove that s/he did not contribute to the creation of the circumstances, and as soon as the uncontrollable circumstances ceased to exist, the person appeared or surrendered.
