Delivery of Property Law and Legal Definition
Delivery of property in the sense of the order means surrender of property. [Marcus v. Pennsylvania Trust Co., 23 F.2d 303, 304 (3d Cir. Pa. 1927)].
A delivery is essential to the validity of a gift; there has to be an actual, constructive, or symbolical delivery of the property to the donee, or to some one for him, in execution of the gift, and for the express purpose of consummating it.
