According to 34 CFR 97.102 (a) [Title 34 – Education; Subtitle A -- Office of the Secretary, Department of Education; Part 97 -- Protection of Human Subjects; Subpart A -- Federal Policy for the Protection of Human Subjects (Basic Ed Policy for Protection of Human Research Subjects)] the term department or agency head means “the head of any federal department or agency and any other officer or employee of any department or agency to whom authority has been delegated.”
