Different-Department Rule Law and Legal Definition
Different department rule is a principle of employment law, according to which people who work for the same employer are not fellow servants if they do not do the same work or do not work in the same department. This is an exception to the fellow-servant doctrine which bars or reduces the amount of money an injured employee can recover against an employer if the injury was caused solely by the negligence of a fellow worker. However, this rule has only limited application and has been rejected by courts of various jurisdictions.
