Disclosure [Education] Law and Legal Definition
According to 34 CFR 5b.1 (d) [Title 34 – Education; Subtitle A -- Office of the Secretary, Department of Education; Part 5b -- Privacy Act Regulations], the term disclosure means “the availability or release of a record to anyone other than the subject individual.”
According to 34 CFR 99.3 [Title 34 – Education; Subtitle A -- Office of the Secretary, Department of Education; Part 99 -- Family Educational Rights and Privacy; Subpart A – General], the term disclosure means “to permit access to or the release, transfer, or other communication of personally identifiable information contained in education records by any means, including oral, written, or electronic means, to any party except the party identified as the party that provided or created the record.”
