Discrimination Against Handicapped Individuals [Aviation Law] Law and Legal Definition
Discrimination is the prejudicial treatment of an individual based solely on their membership in a certain group or category. An air carrier, including any foreign air carrier, may not discriminate an individual while providing air transportation on the basis of physical or mental impairment that substantially limits one or more major life activities. Such an individual may not be discriminated if s/he has a record of such impairment or s/he is regarded as having such impairment. Violation of any of the above conditions is regarded as separate offense. [49 USCS § 41705]
