Disposing Capacity Law and Legal Definition
Disposing capacity means the mental ability or state of mind that a person should possess to prepare a valid will. It is also known as testamentary capacity.
Factors such as: a person ‘s ability to know and recognize the natural object of his/her bounty, the nature and extent of his/her estate, and the fact that the person is making a plan to dispose of his/her estate after his/her death, all come under a person’s disposing capacity.
