Divided Court Law and Legal Definition
Divided court is an appellate court whose opinion or decision in a particular case is not unanimous. It is the division of the judges or justices on the decision to be rendered. Division does not affect the character of the case as a precedent, unless the court is equally divided, in which case, the doctrine of stare decisis has no application.
