Division of Opinion Law and Legal Definition
Division of opinion arises, when the parties having a right to vote are so divided that there is not a plurality of the whole in favor of any particular proposition. In Roman law, when there is division of opinion among judges, the opinion of the judge ordering lowest punishment or which is in favor of the defendant shall prevail.
