Divisional Application Law and Legal Definition
Divisional application is a patent application based on the same disclosure as the original application but claiming a different invention. As a rule, only one invention may be claimed in a patent application. If an application contains more than one invention the applicant will be asked to “elect” which invention will be prosecuted. The remaining invention or inventions may then be prosecuted by means of a divisional application. It will have the same filing date as the parent application. Divisional application is also known as restricted application.
