Dually Certified Nursing Facility Law and Legal Definition
A dually certified nursing facility refers to a nursing facility having dual certification as a skilled nursing facility and a nursing facility. Facilities with dual certification can admit Medicare or Medicaid patients to either their skilled nursing facility or nursing facility. However, a dually certified nursing facility must comply with the common Medicaid and Medicare regulations. Where the Secretary of Health and Human Services finds that a dually certified nursing facility is not in compliance with these requirements, it has authority to impose remedies on the facility, including termination, under both the Medicare and Medicaid Acts.
