Eligible Locations for Smart Growth Law and Legal Definition
Eligible locations for smart growth refer to those areas where an authority can initiate smart growth land development.
The following is a state law that provides a statutory framework regarding eligible locations for smart growth:
Eligible locations include:
a. areas near transit stations;
b. areas of concentrated development; or
c. areas that by virtue of their infrastructure, transportation access, existing underutilized facilities, and/or location make highly suitable locations for residential or mixed use smart growth zoning districts. [ALM GL ch. 40R, § 1]
