Enabling Requirement Law and Legal Definition
Enabling requirement refers to a legal rule applied in patent law. Enabling requirement is a rule that requires the specification of a patent application to describe the invention. Enabling requirement facilitates a person with ordinary skill in the art to make and use the invention without experimenting unduly.
The enabling requirement provides that the patent application must contain a written description of the invention, and of the manner and process of making and using it, as to enable any person skilled in the art to which it pertains to make and use the same. The enabling requirement is directed to one skilled in the art, and demands that the inventor should describe the device in such a manner which is sufficient to enable one skilled in the art to make and use it.
