Encroachment Law and Legal Definition
Encroachment is the illegal intrusion into a property with or without obstruction. The term covers all property, highway, or navigable river. [State of Cal. ex rel. State Lands Com. v. Superior Court, 36 Cal. App. 4th 114 (Cal. Ct. App. 1993)].
The following is an example of a state statute (Louisiana) defining “encroachment”:
Pursuant to La. R.S. 41:1704 “Encroachment” means any construction, or improvement, obstacle, fill, or material which is placed upon or maintained upon state lands.
