According to 41 CFR 60-3.16 ( Title 41 - Public Contracts And Property Management; Subtitle B - Other Provisions Relating To Public Contracts; Chapter 60 - Office Of Federal Contract Compliance Programs, Equal Employment Opportunity, Department Of Labor; Part 60-3 - Uniform Guidelines On Employee Selection Procedures (1978) (Definitions), enforcement action means “for the purposes of section 4 a proceeding by a Federal enforcement agency such as a lawsuit or an administrative proceeding leading to debarment from or withholding, suspension, or termination of Federal Government contracts or the suspension or withholding of Federal Government funds; but not a finding of reasonable cause or a conciliation process or the issuance of right to sue letters under title VII or under Executive Order 11246 where such finding, conciliation, or issuance of notice of right to sue is based upon an individual complaint.”
