Evading arrest is a crime governed by federal and state laws, which vary by state. It generally involves when a person intentionally flees from a person he knows is a peace officer attempting lawfully to arrest or detain him.

Evading arrest is defined as follows:
(a) It is unlawful for any person to intentionally flee from anyone the person knows to be a law enforcement officer and the person:
(1) Knows the officer is attempting to arrest the person; or
(2) Has been arrested.
(b) It is a defense to prosecution under this section that the attempted arrest was unlawful.
