Ex contractu is a Latin term which means “from a contract.” This legal term indicates a consequence of a contract. Ex contractu is often to denote the source of a legal action. Usually damages ex contractu will lie for nonfeasance, misfeasance and malfeasance; whereas damages ex delicto will only lie for misfeasance and malfeasance.
An action ex contractu refers to a personal action arising out of a contract.
