Ex-Delicto Action Law and Legal Definition
Ex-Delicto Action refers to a personal action arising out of a tort. These actions were originally the action for trespass and action for replevin. In common law this refers to an action by which a plaintiff could recover the money paid to the defendant. The money was recoverable because it has been paid by mistake or compulsion or when there is insufficient consideration.
