Ex Turpi Causa Non Oritur Actio Law and Legal Definition
Ex turpi causa non oritur actio is a Latin term which means “from a dishonorable cause an action does not arise.” This legal doctrine states that a person will be unable to pursue a cause of action, if such action arises as a result of his/her own illegal act. Hence parties who knowingly entered into an illegal contract may not be able to enforce it ; a person injured by another while jointly committing a serious crime may not be able to sue for damages. This principle is relevant in the law of contract, tort and trusts. Ex turpi causa is also known as the “illegality defense.”
