Existing Construction Law and Legal Definition
According to 44 CFR 59.1 (Title 44 - Emergency Management And Assistance; Chapter I - Federal Emergency Management Agency, Department Of Homeland Security; Subchapter B - Insurance And Hazard Mitigation; Part 59 - General Provisions; Subpart A – General), existing construction, means for the purposes of determining rates, structures for which the “start of construction” commenced before the effective date of the FIRM or before January 1, 1975, for FIRMs effective before that date. Existing construction may also be referred to as “existing structures.”
