Express Assumpsit Law and Legal Definition
An express assumpsit is where one undertakes verbally or in writing, not under seal, or by matter of record, to perform an act, or to pa a sum of money to another. Assumpsit is a Latin term, meaning ‘he undertook.’ Express assumpsit is an action based on the defendant’s breach of an express contract. It is also known as special assumpsit.

Corporations are also liable in the action of assumpsit, the same as individuals and an express assumpsit may be proved from the acts of the corporators themselves, or of their authorized agents. [Stone v. Congregational Soc'y, 14 Vt. 86, 90 (Vt. 1842)].
