Failure to surrender is a crime where a person who has been released on bail as part of criminal proceedings fails without reasonable cause to surrender to custody.
The elements of this offence are:
• The person was sentenced to a term of imprisonment;
• The person was ordered to surrender for service of the sentence on a certain date;
• The person knew of the order to surrender; and
• The person intentionally failed to surrender as ordered.
